Use this email template to get pesky hijackers off of your listing!
(Seller Name) Representatives,
It has come to our attention that you are using our product listing – (listing title here)- to sell a substitute product that is counterfeit and not a (your product brand name here) product.
Our product listing, all of the images, and all of the text to describe the product have been registered with the United States Government Copyright Agency.
Therefore, by using our product listing without our express permission, you are breaching the copyright laws of the United States and liable to substantial legal punishment.
Our (product name) also has a unique UPC on the product packaging. We have never granted permission to your company to sell our products with our UPC nor have we sold you inventory for resale. This also puts you in breach of Amazon policy on the restrictions for product matching the listing description.
To quote from Amazon policy: “Prohibited Seller Activities and Actions – Matching product offerings inaccurately: When listing items for sale using an existing product detail page, the product being offered must be listed on a product detail page that accurately describes the product in all respects, including with respect to the following attributes: manufacturer, edition, binding, version, format, or player compatibility. Sellers may not match their item to a detail page with a different ISBN, UPC, EAN, or other external identifier.” And further: “Condition Notes – Unacceptable and Prohibited Items: Item was not created by the original manufacturer or copyright holder. This includes copies, counterfeits, replicas, and imitations.”
This email brings to your attention your breach of Amazon policy and of United States Government Copyright laws.
This email serves as your LEGAL NOTICE to CEASE AND DESIST all further actions described above, including any mention of our Products/Company on your listings, on the Amazon Marketplace, on websites, or other marketing efforts.
Should you fail within 24 hours to remove your illegal listing of our product, our first action will be to report this violation to Amazon where you will face having your selling privileges on Amazon removed. Further legal action will follow if you do not remove this illegal listing.
